Terms & Conditions

Last updated: 3 September 2026

These Terms & Conditions ("Terms") govern your use of Bags That.

Bags That is an independent project operated by Lindsay Evans in New South Wales, Australia ("Bags That", "we", "us" or "our").

By creating an account or using the Bags That website, application or related services (the "Service"), you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

1. About Bags That

Bags That is a gift wishlist and coordination service. The Service allows users to do things such as:

  • create groups;
  • invite friends and family;
  • create recipient profiles;
  • create wishlists and occasions;
  • share gift ideas and product links;
  • reserve gifts;
  • coordinate gift purchases privately;
  • leave comments; and
  • ask and answer gift-related questions.

Bags That does not ordinarily sell the gifts listed through the Service. Unless we expressly state otherwise, purchases from linked retailers are transactions between you and the relevant retailer.

2. Eligibility

You must be at least 18 years old to create a Bags That account.

By creating an account, you confirm that you meet this requirement and that information you provide about yourself is accurate.

Adults may create recipient profiles and wishlists for children or other people who do not have Bags That accounts.

If you create a profile for someone else, you should have an appropriate relationship with or authority from that person, or their parent or guardian where relevant, to provide their information.

3. Your account

You are responsible for activity carried out through your account. You must:

  • provide accurate account information;
  • keep access to your account secure;
  • not knowingly allow another person to impersonate you;
  • promptly notify us if you believe your account has been compromised; and
  • comply with these Terms when using the Service.

Bags That may support passwordless or third-party authentication rather than traditional passwords.

4. Groups and invitations

Bags That allows users to create and join groups. The person creating or administering a group may be able to:

  • invite and remove members;
  • create recipients;
  • create occasions;
  • manage group settings; and
  • assign certain permissions.

Only invite people you intend to give access to the relevant group information. Invitation links should not knowingly be shared with unauthorised people.

5. Recipient privacy and surprises

A central feature of Bags That is allowing members to coordinate gifts without revealing that coordination to the recipient.

The Service may therefore hide information from a recipient, including:

  • whether a gift has been reserved;
  • who reserved it;
  • purchase status;
  • private buyer notes; and
  • other gift coordination information.

We will take reasonable steps to enforce these visibility rules within the Service. However, we cannot guarantee that a surprise will remain secret.

For example, another group member may disclose information, take a screenshot, discuss a reservation elsewhere, accidentally reveal a purchase or otherwise share information outside our control.

You are responsible for deciding who you trust and invite to your groups.

6. Gift reservations

Features such as "Bags That", "I've got this", "Reserved", "Considering" or "Purchased" are coordination tools only.

A reservation:

  • does not create a legal obligation to purchase the gift;
  • does not guarantee that someone will purchase the gift;
  • does not guarantee product availability or price;
  • does not prevent someone outside Bags That from buying the same item; and
  • does not create a contract between the recipient and the person reserving the gift.

Users should update or release reservations when their plans change so other group members can coordinate effectively.

7. Gift ideas and external information

Users may submit gift ideas including descriptions, product URLs, images, prices, sizes, colours, preferences and other product information.

Product information may become inaccurate or outdated. Bags That does not guarantee:

  • the accuracy of user-provided product information;
  • current prices;
  • product availability;
  • shipping times;
  • retailer stock;
  • product quality; or
  • whether a particular product is suitable for a recipient.

You should confirm important information with the retailer before purchasing.

8. Third-party retailers

The Service may link to websites, products or services operated by third parties.

Bags That is not responsible for a third-party retailer's products, pricing, stock, delivery, returns, warranties, customer service, privacy practices or website availability.

Any purchase you make from a third-party retailer is subject to the retailer's own terms and policies. A link from Bags That does not necessarily mean that Bags That or Lindsay Evans endorses the retailer or product.

9. Affiliate links

Bags That does not currently use affiliate or referral links. If this changes, we will identify affiliate links where appropriate. Following an affiliate link or purchasing from a participating retailer may result in Bags That receiving a commission or referral fee, generally at no additional charge to you.

Affiliate relationships do not change a recipient's wishlist or indicate that Bags That recommends a product unless we specifically say so.

10. User content

"User Content" means content you submit to Bags That, including gift ideas, links, recipient information, comments, questions, answers and images.

You retain ownership of any intellectual property rights you hold in your User Content.

You give Bags That a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically modify and display your User Content as reasonably necessary to:

  • provide the Service;
  • display it to authorised users;
  • operate technical infrastructure;
  • create backups;
  • prevent abuse;
  • improve the Service; and
  • comply with legal obligations.

This licence ends when the content is deleted from our systems, except where retention is reasonably necessary for backups, security, legal obligations or shared group functionality.

You must only upload or provide content that you have the right to use and share.

11. Acceptable use

You must not use Bags That to:

  • break the law;
  • impersonate another person;
  • harass, threaten or abuse others;
  • deliberately expose another person's private information;
  • upload malicious software;
  • attempt to gain unauthorised access to accounts or systems;
  • interfere with the security or operation of the Service;
  • scrape or harvest personal information without permission;
  • send spam;
  • commit fraud;
  • infringe another person's intellectual property rights; or
  • publish unlawful or seriously harmful material.

Content may be removed or access restricted where reasonably necessary to address suspected misuse, security issues or breaches of these Terms.

12. Notifications and email

Bags That may send operational communications necessary to provide the Service, including:

  • authentication emails;
  • invitations;
  • security notices;
  • gift or group notifications;
  • occasion reminders; and
  • important service announcements.

Bags That does not currently send marketing communications. If this changes, they will only be sent where you have consented or where otherwise permitted, and will include an unsubscribe mechanism.

Some essential account or transactional communications may continue while you use the relevant parts of the Service.

13. Free and paid features

Bags That may offer both free and paid features in the future.

If paid features are introduced, the applicable price, billing frequency, inclusions, renewal arrangements and cancellation terms will be shown before you purchase them.

You will not be charged simply because you use a free feature unless you have agreed to a paid service. Additional terms may apply to particular paid features.

14. Changes to the Service

Bags That is an independently developed project and is likely to evolve over time.

Features may be added, modified or removed where reasonably necessary to:

  • improve the Service;
  • fix technical or security problems;
  • comply with legal requirements;
  • respond to changes in third-party services; or
  • discontinue features that are no longer reasonably practical to operate.

Where a material change adversely affects a paid service, reasonable notice will be provided where practicable and any rights required by applicable law will continue to apply.

15. Availability

Bags That is provided on a reasonable-efforts basis.

The Service may occasionally be unavailable because of maintenance, bugs or software errors, infrastructure failures, security incidents, third-party outages or circumstances outside our reasonable control.

Because Bags That is an independently operated project, continuous or permanent availability of the Service cannot be guaranteed.

16. Account suspension and termination

You may stop using Bags That and request deletion of your account at any time.

Access may be suspended or terminated where we reasonably believe:

  • you have materially breached these Terms;
  • your account poses a security risk;
  • your use is unlawful or fraudulent;
  • your use creates a serious risk of harm to another user; or
  • we are legally required to do so.

Where appropriate, we may provide notice or an opportunity to correct a breach before terminating an account. Immediate action may be taken where reasonably necessary to protect users, the Service or others from serious harm or security threats.

17. What happens when you leave

If you delete your account or leave a group, some shared content may remain where necessary to preserve the integrity of group conversations, wishlists or records.

For example, a historical comment may remain but be attributed to a deleted user. Personal information associated with account deletion will be handled in accordance with the Privacy Policy.

18. Intellectual property

Except for User Content and third-party material, the Bags That software, branding, design, text, graphics and other original content are owned by Lindsay Evans or used under licence.

You may use the Service for its intended purposes. These Terms do not transfer ownership of Bags That's intellectual property to you.

19. Consumer rights

Nothing in these Terms excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law where it applies.

20. Liability

To the extent permitted by law, Bags That and Lindsay Evans are not responsible for loss caused by matters outside our reasonable control, including:

  • the conduct of other group members;
  • information disclosed by another user;
  • purchases from third-party retailers;
  • unavailable or discontinued products;
  • incorrect product information supplied by users or retailers;
  • retailer delivery failures;
  • a surprise being revealed by another person; or
  • failures or conduct of third-party websites and services.

Where liability exists and the law permits it to be limited, it will only be limited to the extent permitted by applicable law. Nothing in these Terms excludes any liability or remedy that cannot legally be excluded.

21. Privacy

Our handling of personal information is described in the Privacy Policy.

By using the Service, you acknowledge that information you submit may be shared with other members of groups you join in accordance with the Service's features and privacy controls.

22. Changes to these Terms

These Terms may be updated as Bags That develops or legal requirements change.

If a material change affects users, reasonable steps will be taken to notify affected users where appropriate. Changes will not retrospectively remove rights that have already accrued.

The latest version will be available through the Service and will state when it was last updated.

23. Governing law

These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws of Australia.

You and Lindsay Evans submit to the courts having jurisdiction in New South Wales, subject to any rights under applicable law to bring proceedings elsewhere.
